Shetland Market reserve the right to alter or modify these terms at any time. It is the responsibility of Providers and Customers to ensure they are familiar with the current terms and check for updates regularly.

Definitions
Shetland Market - (Abbreviated to SM). The online shopping area and trading name of the website www.shetlandmarket.com
Provider - Any company or individual permitted to list and sell products through the website.
Provider Membership - The process by which prospective providers apply to become a member of the website and are granted or declined membership.
Commission Fee - The charge to a provider to sell products through the website, charged as a percentage of the net sale.
P&P - Postage and Packaging of products
Manufacturer - The term used to describe the origin of products sold on the site. In most cases, the provider is the manufacturer and should specify this when adding products to the site.
Provider Area - The administration area set up for providers to add, modify and delete products, alter stock levels, monitor orders etc

Provider Membership
Shetland Market reserve the right to postpone or withhold provider membership at any time as they wish.
Providers granted membership are bound by these Terms at all times while operating in the site.
Provider Membership is open to: Shetland businesses of all sizes; Non-Shetland businesses providing products strongly related to Shetland (only at the discretion of Shetland Market)
Provider Membership is closed to: Service Providers; All other non-Shetland businesses; Reseller businesses, other than those already trading from a Shetland premises; Businesses who do not hold their stock in Shetland; Chain businesses who also operate outside of Shetland
Membership will be reviewed annually and SM reserve the right to cancel membership for inactive providers
Membership cannot be transferred to other companies or used for other products without the authorisation of SM
Changes in the business type or product type of providers should be communicated to SM immediately

Applying for Provider Membership
Prospective providers must apply for membership on the site and agree to these terms and conditions
SM will notify prospective providers of accepted or declined membership requests within 7 days
On acceptance of membership, SM will then set up a Provider Area, Manufacturer pages and security details for the provider within 14 days
On receipt of these details, providers should begin to list products within 14 days
SM will review new Providers after 28 days and reserve the right to withdraw membership from providers not complying fully with these terms.

Provider Obligations
Providers are responsible for the following;
- Maintaining product listing in their Provider Area, ensuring all active products remain current and up to date
- Maintaining stock levels of active products
- Maintaining Provider's own Manufacturer pages ensuring business information is current and up to date
- Ensuring that security details for the site are kept hidden and confidential at all times and reporting unauthorised changes to their Provider Area
- Checking your email and the site regularly for recent orders
- Ensuring regular access to the world wide web is maintained at all times. Periods of absence (e.g. holidays) must be notified to customers, and orders must still be dispatched in these circumstances, or your account can be temporarily disabled for the period.
- Ensuring that no links to other websites selling provider's products are displayed on the site, especially in the manufacturer pages.
- Ensuring computers used to access the site are virus free
- Recognising the intellectual property rights of SM at all times
- If you need to close your store at any time due to a period of absence that stops you from carrying out your business (e.g. holiday) you must give 14 days notice by email so that your account and products can be temporarily disabled for this period.

Permitted Products
Products that ARE permitted on the site are:
- Products made in Shetland
- Products not made in Shetland, but sourced and sold by a Shetland-based business
- Locally produced food and drink products
Products NOT permitted on the site are:
- Products not sourced locally
- Services
- Cars, Motorvehicles, Boats etc
- Second-hand products (reconditioned products will be considered)
- Products of an adult or controversial nature at the discretion of Shetland Market
- Products already being sold directly from the manufacturer on the site
Products must be in stock
Products must be new

Product Listing
Providers should list products they wish to sell on the site themselves using the administration interface in the Provider Area
Providers are responsible for maintaining and keeping up to date their product listings

Pricing
All prices displayed on the site must be inclusive of all VAT and Taxes. VAT can be specified in products.
Pricing must be in Pounds Sterling (GBP)
Prices should, where possible reflect the high street shop price of the product, or less.

Delivery, Postage & Packaging
The Provider is responsible for the packaging, postage and delivery of all items
Postage and Packaging (P&P) charges should be set by the Provider in their Provider Area
P&P should be applied to order totals, and not for individual products (i.e. £3.95 per order rather than £2 per item)
A maximum P&P charge of £3.95 per order applies to Providers
Shetland Market may choose to allow certain products to be given special P&P rates on request (above £3.95 if necessary)
Providers should aim to be able to offer FREE postage on as many items as possible
Delivery methods used should ensure delivery within 7 days
Items available for pickup only are allowed on the site, but this must be clearly stated in the product description
The delivery method used should be the most efficient and economic available with the customer in mind

Ordering and Delivery Process
Providers must:
- respond to new orders within 48 hours by confirming to the customer directly when they will despatch the order
- must keep customers informed of the progress of orders
- update the status of orders in their Provider Area to "completed" once an order is shipped
- resolve any delivery issues directly with the customer
- be prepared to resend any non-delivered items
- be fully coherent with distant selling laws and comply with these fully

Charges and Payment Terms
Shetland Market will accept all payments from customers on the site directly
Providers shall be paid monthly for their completed sales one weeks in arrears, less the commission fee
Shetland Market charge a commission fee (currently 0% until July 2012, 10% thereafter), which is applied to NET sales including postage, packaging and applicable taxes. (0% special offer is for up to £2000 sales, 10% thereafter)
Items with outstanding customer complaints raised such as non-delivery etc shall not be paid for by Shetland Market until the dispute is settled
Shetland Market will, from time to time, request Providers to take part in offers, discounts or free delivery promotions. Each provider will have the option to opt out of these promotions, but will have to temporarily disable their shop section during the promotion if necessary.
Payment from Shetland Market to providers will be made by direct bank transfer. We will ask for these details when you receive your first order.
Payment from Shetland Market to providers by Paypal is available if you prefer.

Returns and Refunds
Any complaints or disputes should be dealt with privately between the provider and the customer
Providers should give customers a 14 day cooling off period from the despach of the product and should be willing to accept returns during this period. Shetland Market appreciate that this is not possible for some specialist and custom made products and sellers should state this clearly in the product description
Shetland Market will arrange a refund for orders or items within an order if necessary
For faulty items, items not as listed etc, Providers should give a full refund. For items returned for other reasons, such as not wanted, wrong size etc, Providers may choose to not refund any postage or packaging costs charged.
For refunded items or orders, Shetland Market will not charge the commission fee. However, a 5% refund fee shall be charged.

Customer Relations
Providers must make every effort to handle all orders with the highest levels of customer service and communication.
Providers must endeavour to settle all disputes directly with customers and not to involve Shetland Market.
If disputes between individual Providers arise regularly and have to be settled by Shetland Market, Shetland Market may suspend or cancel your seller membership.
Providers must ensure they keep customers informed on order status according to section 10.
Providers must ensure a personal experience for the customer using the site with excellent communication throughout the order process.

Matters Beyond the Control of Shetland Market
Shetland Market reserve the right to suspend or cancel the described service at any time if it is prevented from carrying out its business in circumstances beyond its reasonable control.
If the Shetland Market service is to be suspended or cancelled for any other reason, Shetland Market will give 30 days notice by email to all Providers.
Shetland Market accepts no liability for any legal matters arising against Providers using the site or for any business Providers are responsible for as detailed in these conditions.

This section of the page tells you the Terms & Conditions on which you may make use of the shetlandmarket.com website (Shetland Market), whether as a guest or registered user, and the terms applicable to the sale of goods or services through the website.

Accessing Our Site
Access to the Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Site without notice. We will not be liable if for any reason the Site is unavailable at any time or for any period.

You will need to register with us in order to purchase goods or services from our Providers. Intellectual Property Rights
We are the owner or the licensee of all intellectual property rights in the website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
If you breach these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

How the Website Works
Please note that we accept orders as agents on behalf of our Providers. The resulting contract is between you and that Provder, and is subject, in addition to these Terms & Conditions to the terms and conditions of that Provider, which they will advise you of directly.
You should carefully review their terms and conditions applying to the transaction. We cannot give any undertaking that goods or services you purchase from Providers through the website will be of satisfactory quality, and any such warranties are DISCLAIMED by us absolutely.
This DISCLAIMER does not affect your statutory rights against the Provider. Where you order goods or services through the website we may disclose your customer information related to that transaction to the relevant Provider. We do not review or control, and are not responsible in any way for listings provided by Providers and at no time do we possess any items offered for sale through the website.
Each order you place shall be deemed to be an offer by you to purchase the goods and/or services specified within it subject to these Terms & Conditions and any additional terms and conditions notified to you by the Provider.
No order shall be deemed to be accepted by the Provider until the Provider issues an email acknowledgement of order. The contract will relate only to those goods and/or services notified in the email acknowledgement of order.

All orders through Shetland Market are processed through Paypal, our online payment system
All prices are listed in pounds sterling (£) and are payable in pounds sterling (£)
Note: You do not need to have a Paypal account to pay using their service, although it is quicker if you do have one.

Delivery Arrangements
Your shopping basket on the website displays the goods you have chosen and details of post and packing. The delivery costs for each Provider vary according to the delivery methods they offer. Any delivery times quoted are estimates only, based on availability and normal delivery time in working days.
Delivery outside the UK is not currently available. Please contact us for a quote.

Returns
If you wish to discuss or organise a return, exchange or refund of any item, please contact the Provider directly using their email address from which you received the order confirmation, or by locating the Provider's Manufacturer page on the website.
All Providers provide the following guarantee to all shoppers so that you have peace of mind when ordering any product through the website:
In relation to any goods sold through the website, you have 14 days from receipt of goods in which you can return your items.
Where you return goods within the period specified above (other than as a result of a defect in the goods) you will be responsible for payment of the delivery charges. If you need to return a product, it must be returned in its original condtion and be un-used.
There are naturally exceptions to the returns terms shown above, where for instance products are specially made, so please always double check the returns policy directly with the Provider concerned. The following items are likely to be non-returnable and non-refundable:
- personalised items that are specially made, or ordered, with your choice of name, fabric, message or other customized aspect;
- perishable products, including food and flowers;
- personal products such as underwear, jewellery (especially earrings), cosmetics;
- large items of furniture which are often specially made or ordered;
- homewares that are made up in your own choice of fabric or material, such as lampshades, throws, cushions and other items;
- art, sculpture, ceramics and other creations that are often specially commissioned when you place an order.
